The Public Defender’s paralegal staff has assisted clients in filing hundreds of requests per year to expunge their records and/or terminate probation early. These requests are made to those who have successfully completed all terms of their sentence and supervision time and have led productive lives since their sentence. Along with filing several hundred petitions under Proposition 47 which reduced convictions from felonies to misdemeanors, all of these clients now have access to better housing and meaningful employment due to the assistance of our office.
California Penal Code § 1203.4 expungement appointments are set three days a week in the morning at 30 minute increments starting at 9:00 a.m. Court hearings will be set and the appropriate agencies will be served notice of the hearing.
Certificate of Rehabilitation and Pardons for parties that have the residency requirement in California and live in Stanislaus County are also prepared by our staff along with Clemency Pardons for those that are not eligible for a Certificate of Rehabilitation and Pardon due to the fact that they do not reside in this State or their conviction makes them ineligible.
Modification or termination of probation requests are also handled for those clients who have completed one year of formal or informal probation and there is a significant change in circumstances that would possible warrant the modification or early termination of employment.
Factual innocence motions are also prepared for individuals that can prove their factual innocence whereas their case was dismissed and no conviction under Penal Code Section 851.8.
