Effective January 1st, 2010 the following changes take effect:

Birth and Death’s abroad no longer recordable:

California Health and Safety Code Section 103505(a) - Repeals the authority of the County Recorder to record a certificate of birth or death originating outside the United States. Certification of birth or death outside of the United States shall not be recorded by the County Recorder.

Contractual Assessments: Water Efficiency Improvements

California Civil Code Section 1102.6(b) - Creates a document entitled Contractual Assessments: Water Efficiency Improvements allowing public agencies to enter a voluntary contractual assessment to finance water efficiency improvements.

California Health & Safety Code Section 5898.24(d) (1) - Requires a NOTICE be recorded to accompany the Contractual Assessments: Water Efficiency Improvements document and prescribes the content of the NOTICE to satisfy statutory requirements.

Social Security number requirements

California Civil Code Section 1798.89 - Provides privacy protection for Social Security Numbers. As of January 1st, 2010 a document containing more than the last four digits of a social security number is not entitled for recordation.

Notice of Reclamation Plan Approval

California Public Resources Code Section 2772.7- Requires the NOTICE of Reclamation Plan Approval include language that states “Mining operations conducted on the hereinafter described real property are subject to a reclamation plan approved by the (insert name of lead agency), a copy of which is on file with the (insert name of agency where the plan is filed), the name of the owner of record, description/identification of property, signature of the lead agency, signature acknowledged of the lead agency representative.”

Notice of Reinterment of Native American Remains

California Public Resources Code Section 5097.98(e)(3)- Establishes a document entitled “Notice of Reinterment of Native American Remains” and specifies the information a property owner must record with a County Recorder in order to protect sites of Native American remains. The recording requirements include: name of the property owner, description/identification of real property, signature of the property owner, acknowledgement of signature.

California Assembly Bill 645 -Deletes the surveyors license expiration date requirement which was previously on the surveyor’s statement on a survey map.
